An owner of a trademark can seek to obtain registration both in Malta and in the EU as a whole through the community trademark application. Should the trademark pass the requirements imposed by the local authorities or the EUIPO as applicable, the trademark would obtain successful registration.  What is important here is that the trademark is distinctive in its nature and thus is not similar to any other registered marks in the same sector and also not descriptive in relation to its scope.

It is important to note that a wide variety of trademarks can be registered as follows:

  • Word mark
  • Figurative Mark
  • Figurative Mark containing word elements
  • Shape mark
  • Sound mark
  • Shape marks containing word elements
  • Position Marks
  • Pattern Mark
  • Colour (single) mark
  • Color (combination) mark
  • Sound Marks
  • Motion Marks
  • Multimedia Mark
  • Hologram Mark

Prior to the application for registration, a trademark can be classified as under any one or a combination of the 45 classes of goods and services as listed and an appropriate analysis of the goods and services of the client is essential for proper classification and registration.
